WARNING OF RISK
Activities involving the use of a swimming pool carry significant risk of sustaining injuries from slippery surfaces, foreign objects in the pool, and other general hazards associated with swimming.These hazards carry with them the risk of injury up to and including death by drowning.Proper attire, swimming ability, and safe behavior are required.You are responsible for understanding your own capabilities and limitations with respect to swimming.
RELEASE FROM LIABILITY
In consideration for my use of the Wendell Swim Club Association, INC (WSC) pool facilities, I, on behalf of myself, my family, personal representatives, heirs, and/orassigns, hereby forever release and covenant not to sue the WSC, its members of the Board of Directors, officers, directors, employees, agents, and volunteers, acting officially or otherwise (“WSC Parties”), from and against any present or future claims, losses, liabilities, claims, damages, judgments, and costs of any kind which arise out of or in any way are connected with my use of the WSC pool facilities by myself or by any minor child(ren)
of which I am the parent or guardian, including but not limited to any claims related to exposure to or infection with COVID–19. I further agree to indemnify and hold harmless the WSC Parties for any and all claims arising from my use of the pool facilities, including any negligence of myself or household members, any injury, illness or death, or any COVID–19 related health issue or exposure.
MEDICAL TREATMENT CONSENT
In case of a medical or surgical emergency, I hereby give permission to any medical personnel selected by pool staff to administer treatment.I will assume full responsibility for any such action, including payment of all costs.
AUTHORIZATION FOR USE OF PHOTOGRAPHS/VIDEOS
I hereby agree that any pictures or videos of me or, if applicable, my child(ren) may be used for pool training, advertising, or promotion without any compensation to me or my child(ren).
RISK OF INJURY/ILLNESS
I understand that the use of the pool and equipment may pose risks to me or my child(ren), including the risk of serious injury, disability, illness, or death.
NON-PAYMENT OF MEMBERSHIP DUES
[excerpt from ByLaws found on website] SECTION 2.Non-Payment of Dues. Failure to pay dues as set forth in Section 1, Dues, above shall result in a “late fee(s)” as set forth by the directors and assessed to the shareholder. Any accumulation of unpaid dues by December 31st of the current year will enable the retirement of the shareholder’s stock as corporate stock. The Corporation may retire the stock by paying those unpaid dues to itself and by paying the sum of Ten Dollars ($10.00) to the shareholder of record.
It is the intent of Section 1, Dues, and Section 2, Non-Payment of Dues, to impose, fairly and uniformly, dues on every shareholder of record, and to provide for the regular, systematic and voluntary payment of same by every owner of record and further, to provide a method whereby those owners of stock who refuse to pay dues in such a manner, may lose their right to decide for themselves who may use their stock for the current year. Additionally, it is the intent to provide a method whereby shares of stock owned by parties failing to pay dues may be retired as corporate stock so that new stock can be issued to a party willing to pay dues.
